Dependents of H-2 and H-3 Visa Holders (H-4)
The spouse and children under the age of 21 of a temporary worker in a non-specialty occupation (H-2) or trainee (H-3) may apply for an H-4 visa together with the H-2 or H-3 principal applicant, or they may apply later for an H-4 visa if they can present proof of H-2 or H-3 visa issuance. Please note that approval of a petition does not guarantee visa issuance to an applicant found to be ineligible under provisions of the Immigration and Nationality Act.
APPLYING FOR A VISA
- Please follow the steps listed on the “How to apply” page to submit your application and prepare the required documents.
- Please provide the receipt number of the H-2 or H-3 holder’s approved I-129 petition. It is also very helpful if you bring a copy of the I-129 petition and a copy of the I-797 Notice of Approval to your visa interview.
- Please present proof of your relationship to the principal applicant. Such proof may include original birth or marriage certificates or household registration record.
- Please present evidence to show that you have a residence abroad to which you intend to return at the end of the stay in the US. This is generally established by evidence of family, professional, property, employment or other ties and commitments to some country other than the US sufficient to cause you to return there at the conclusion of your stay.
